Terms and Conditions for the Birb App
General Provisions
These "Terms and Conditions" (hereinafter referred to as the "Terms") govern the use of the Birb mobile application (hereinafter referred to as the "App") and constitute a binding Agreement between you, the User, and Birb, regulating the right to use web applications, websites, programs, and other services offered by Birb. In these Terms, "Birb", "App", "we", "our", or "us" refers to the legal entity Birb OÜ, as specified in Appendix 1, with whom you are entering into this Agreement. By using our App, you agree to these Terms and consent to the processing of your personal data.
Product Description
Birb is an app for searching and renting apartments that performs searches for listings and sends notifications based on the User's individual needs and requests.
Subscription Terms
3.1. Birb provides users with an AI assistant service that performs property rental searches, including but not limited to searching for rental listings on real estate websites, sending those listings, and more.
3.2. The subscription can be for 7 days, 1 month, or 1 year.
3.3. Upon downloading the App, the User undergoes a test survey consisting of 20 questions to generate the User’s apartment search request. After completing the test survey, Birb provides the User with free access to the App for 7 (seven) days. The free access to the App begins upon authentication via the Stripe payment system.
3.4. On the 6th (sixth) day of free usage, Birb sends a reminder about the end of the free 7-day period and offers a subscription plan according to the proposed tariffs.
3.5. The subscription becomes active immediately after the User makes the payment.
3.6. Subscription payments will be automatically charged to your account until the subscription is canceled.
3.7. The User may cancel the subscription at any time through the account settings. Paid subscription fees are non-refundable.
3.8. If the subscription is canceled manually via the app, the User may continue using the service until the end of the paid subscription period.
Pricing
4.1. Subscription costs:
- 7-day subscription: €40.00
- Monthly subscription: €30.00
- Annual subscription: €40.00
4.2. Birb reserves the right to change subscription rates by unilaterally posting information regarding updated rates in these Terms and Conditions.
4.3. All prices displayed in the App may vary depending on the country and currency used in your region. All payments are processed according to the local laws of the United Kingdom, Netherlands, Germany, Poland and other countries. The applicable legislation regarding payments depends on your location.
4.4. If you pay in a currency different from the one in which the subscription price is stated, your bank may apply its current exchange rate and/or add fees and charges in addition to our subscription fee.
4.5. Subscription purchases are processed by the third-party provider, Stripe, in accordance with its latest Terms of Service (or equivalent) and Privacy Policy. Birb is not responsible for any personal data processed by Stripe.
Data Protection
5.1. Birb is committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) applicable in the EU and the UK Data Protection Act.
5.2. We collect and process personal data only to the extent necessary to provide our services. Birb does not collect information such as the user’s name, billing address, or other data that could be used to directly identify an individual.
5.3. The data we collect includes: email address, Instagram and WhatsApp username, search queries (city, district, number of rooms, etc.), payment information, technical data that may potentially identify you, such as your Internet Protocol (IP) address, registration details, timezone settings, etc.
5.4. Why we use your data: Birb uses User data to improve the service, maintain the App, provide recommendations, and ensure the security of your transactions.
5.5. You have the right to request access to, correct, or delete your data at any time by contacting us and sending a request to our email: ars@birb.rent.
Use of Cookies and Analytical Tools
The Birb does not use its own cookies for data collection. However, we use third-party analytical tools such as Google Analytics, Meta Pixel, and other similar services to collect anonymous information about how our site is used, which helps us improve user experience and content effectiveness. These services may use cookies to gather statistics on your interaction with our site. The use of cookies and data collection is governed by the privacy policies of the respective third-party providers.
Cities Where Birb Operates
7.1. Birb provides services in the following cities:
- London (United Kingdom): services are governed by UK law.
- Amsterdam (Netherlands): services comply with Dutch law and consumer protection requirements.
- Berlin (Germany): services comply with German regulations for digital platforms and data protection laws (GDPR).
- Warsaw (Poland): services comply with Polish law, including consumer rights and data protection requirements.
7.2. The list of cities where Birb provides apartment search services is not exhaustive and may be updated or changed.
Intellectual Property Rights
8.1. All content available through Birb, including but not limited to apartment rental listings, images, texts, logos, and designs, is the property of the respective individuals who posted such listings. Birb searches for listings from external sources and displays them for the convenience of Users, without altering, reproducing, or infringing upon the intellectual property rights of the original content creators. Birb ensures that the search and display of listings do not violate copyright laws, as Birb does not claim ownership of any third-party content. The App operates within the boundaries of fair use and in compliance with applicable copyright and intellectual property laws.
Limitation of Liability
9.1. Birb is not liable for any indirect, incidental, or consequential damages resulting from the use of the App or the inability to use it, including but not limited to network issues or technical failures.
9.2. Birb is not responsible for the accuracy, completeness, or truthfulness of listings posted within the App. All information in the listings is the property and responsibility of the respective authors or the original website owners. The App merely aggregates listings from external sources for the convenience of Users, without conducting additional checks or verifications of their content.
Changes to the Terms
10.1. Birb reserves the right to amend these Terms at any time. You will be notified of any changes through the App or by email. Continuing to use the App after changes are made constitutes your acceptance of the updated Terms.
